The most complicated part about meeting state and federal requirements is
knowing what to do first. In this section, steps will be given to map out the
timing of applications and forms needed for registration or authority. This
section will not address requirements for compliance with safety rules and
regulations, vehicle titling, obtaining license plates, commercial drivers
license, oversize/overweight permits or meeting fuel tax requirements. These
requirements can be found by accessing information on this web site or other web
sites. Please see the "Related Links" area on the main menu.
Before mapping out any trip, you must first decide where you are going. The same holds true for trying to map out the process needed to comply with state and federal registration requirements. You must first determine what type of hauling you will be performing, what states you will be transporting property in and through and if you will be operating for-hire or transporting your own commodities.
TO START OUR MAPPING PROCESS, ANSWER THE FOLLOWING QUESTIONS AND PROCEED AS DIRECTED.
Question 1. Will I be hauling for-hire?
If your answer is "Yes", go to Question 2.
If your answer is "No", then you will not be required to register with this Agency and you are finished with this section.
Question 2. Will I be hauling only non-processed farm commodities from the farm to the first market BETWEEN POINTS IN MISSOURI?
If your answer is "Yes", then you will not be required to register with this Agency and you are finished with this section.
If your answer is "No", go to Question 3.
Question 3. Will I be hauling only non-processed farm commodities from the farm to market BETWEEN MISSOURI AND OTHER STATES?
If your answer is "Yes", go to STEP 3 below.
If your answer "No", go to Question 4.
Question 4. Will I be picking up and delivering passengers or property only in Missouri?
If your answer is "Yes", go to STEP 4 below.
If your answer "No", go to STEP 1 below.
STEP 1. TRANSPORTING PASSENGERS OR PROPERTY OTHER THAN NON-PROCESSED FARM PRODUCTS FOR-HIRE ACROSS THE STATE LINE.
You must first apply for interstate authority from Federal Motor Carrier Safety Administration (FMCSA). Forms to register this authority with FMCSA may be obtained by contacting Motor Carrier Services at 573-751-3358; the Regional, FMCSA office in Jefferson City at 573-636-3246 or by filling out an application on the internet at http://diy.dot.gov/diyhome80.htm. To help you in planning the start up of your business, on the average, it takes FMCSA approximately a month to process this application. Once you have this authority, you must follow Step 2 and register this authority in your base state. This process can be issued within days if everything is on file with our agency.
STEP 2. REGISTERING INTERSTATE AUTHORITY IN YOUR BASE STATE.
Once FMCSA has issued the certificate or permit, you must register this authority in your base state under the Single State Registration System (SSRS). The base state is determined by the principal place of business of the motor carrier. The principal place of business is a single location that serves as a motor carrier's headquarters and where it maintains or can make available its operation records. If your company is located in Missouri, this Agency will be your registration state. You will be required to fill out a RS-1 application form, a RS-2 form showing the states of travel, submit the fees, a copy of the authority granted by FMCSA, file a copy of the BMC 91 or 91X (proof of insurance) and a copy of the BOC-3, Designation of Local Process Agents. A carrier may mail a personal/company made payable to the Director of Revenue for fees due. When these items have been completed, the base state will issue a RS-3 form to be placed in the cab of the vehicle. The instruction sheet with the form under the Forms button on the Main Menu will explain this application process and requirements in more detail.
STEP 3. TRANSPORTING NON-PROCESSED FARM PRODUCTS FROM A MARKET AND OTHER EXEMPT COMMODITIES FOR-HIRE ACROSS THE STATE LINE.
You must complete an A-1 application to haul these commodities, file proof of insurance (Form E), fill out a B-1 form and pay a regulatory fee of $10 per vehicle. A carrier may mail a personal/company check made payable to the Director of Revenue. The credential you will be issued will depend on the various types of authority held. If interstate exempt authority is all that is applied for and you are not located in a non-reciprocal state, you will be required to carry in the cab of the vehicle a Form D-1 Cab Card (Bingo Card) with a Missouri stamp on the Missouri block. In addition, you must contact each state of travel to determine if that state has requirements for registration of exempt commodities.
STEP 4. TRANSPORTING PASSENGERS OR PROPERTY (Other Than Non-Processed Farm Products From A Farm) FOR-HIRE WHOLLY IN MISSOURI.
You will need to complete a MO-1 application form to pickup and deliver property (including household goodsor passengers) for-hire in Missouri. Along with a completed application, you will be required to file proof of insurance (Form E) and have systems and procedures in place to comply with the safety regulations. You must submit $10 for each vehicle you plan to operate within this state unless fees have been paid under other authority using a B-1 form. A carrier may use a personal check made payable to the Director of Revenue.Dependent upon the type of authority requested, you may be required to specify the area you desire to operate, submit a statement of rates and charges and possibly submit a financial statement. APPLICATION FORMS AND FURTHER INFORMATION Applications and instruction sheets for registration of authority are available from this web site under the Forms and Manuals selection. The Question and Answer section will explain the limits of liability for insurance purposes and additional areas of exceptions to registration requirements. It is recommended that you browse the Question and Answer section to make sure you need to register authority with the Agency and use the proper forms needed. Failure to use the proper forms will only delay the time in registering your motor carrier operation.
